May 3, 2005 - Court Contempt ruled against NY Intimates
On April 25, 2005, Judge Manuel Real of the United States District Court for the Central District of California, entered a judgment of contempt against NY Intimates, Inc. and its president Tatyana Abramyan because of their failure to abide by the terms of a judgment which had previously been entered against NY Intimates.
Bragel, Inc. the producer of the extremely successful NuBra strapless bra, had sued NY Intimates for infringement of a patent on the NuBra based on NY Intimates' unauthorized sale of a duplicate of Bragel's patented product. The federal court found that NY Intimates had willfully infringed Bagel's patent and permanently enjoined NY Intimates and its officers, employees and others in privity with them from making, distributing, selling or importing any product which infringes Bragel's patent. Despite this clear injunction, NY Intimates and its president Tatyana Abramyan continued to sell and distribute the knock-off bra which had been the focus of Bragel's complaint. In view thereof, the court has held NY Intimates and Abramyan to be in contempt of Court and has ordered them to promptly purge the contempt by proving to the court that all enjoined activities have ceased; accounting to Bragel for all of its sales since entry of the judgment in November 2004; to pay Bragel NY Intimates' profits from such sales or $75,000, whichever is greater, and to pay Bragel's attorney's fees. The Court has also ordered a running penalty of $1,000 per day that NY Intimates and Abramyan do not make the required disclosures and payments.
