LOS ANGELES, CALIFORNIA, October 28, 2004— Federal District Court Judge Margaret Morrow granted an order in favor of Bragel International, Inc., producer of the hugely successful NuBra® brassier, which bars Tatyana Abramyan and Elena Abramyan, the principals behind BG International and gounbra.com, from distributing any product packaged with either of the terms NuBra or Un Bra. In addition, Tatyana and Elena Abramyan were ordered to pay Bragel International, Inc.’s attorneys’ fees and costs.

Bragel International, Inc. filed an action against Tatyana and Elena Abramyan, charging them with selling a product that was a replica of Bragel International's product. Bragel’s product, called the NuBra®, which is a unique strapless bra that is self-adhesive and reusable, has a unique product packaging that is marketed to consumers. The Abramyans tried to capitalize on this unique packaging by using substantially similar packaging and a confusingly similar trademark, namely, UnBra.

In December 2003, Bragel International successfully obtained a temporary restraining order and preliminary injunction prohibiting the Abramyans from the marketing of UnBra-labeled products and packaging. As stated by David Chen, the VP Operations of Bragel International, "people like the defendants in this action severely harm American manufacturers like Bragel, and we are pleased that the Court saw fit to enjoin a blatant infringer thereby helping American industry."

As stated by Rod S. Berman, Bragel’s litigation counsel, “This decision sends a clear message to others who may attempt to infringe on Bragel International, Inc.’s intellectual property rights that Bragel will pursue its remedies to the fullest.”
